Residente de Detroit afirma que agentes de ICE le fracturaron la rodilla y cuestiona la versión de la agencia

Una residente de Detroit que busca asilo y que resultó lesionada durante un encuentro con agentes de U.S. Immigration and Customs Enforcement (ICE) el mes pasado presentó una declaración jurada que contradice la versión de los hechos ofrecida por la agencia.

Yerlys Moreno López, una solicitante de asilo venezolana, dijo que agentes de ICE la derribaron al suelo después de una persecución y choque vehicular ocurrido el 19 de mayo, provocándole una fractura en la rodilla y otras lesiones que requirieron cirugía de emergencia. La agencia sostiene que las lesiones ocurrieron durante el accidente automovilístico. Sin embargo, los expedientes médicos presentados por sus abogados parecen respaldar la versión de Moreno López. Horas después del incidente, mientras era atendida en el hospital, Moreno López les dijo repetidamente a los médicos que resultó herida después de salir de su vehículo.

Las lesiones de Moreno López aumentan las preocupaciones sobre el uso de tácticas cada vez más violentas por parte de ICE durante el segundo mandato del presidente Donald Trump. Moreno López, quien ingresó legalmente a Estados Unidos en 2024, acababa de salir de su casa en el lado este de Detroit el 19 de mayo cuando agentes de ICE intentaron detenerla.

Según su declaración jurada, intentó alejarse conduciendo antes de que los agentes le cerraran el paso, provocando que su SUV chocara contra un vehículo estacionado.

Jennifer Newby, abogada asistente del U.S. Department of Justice, afirmó ante una corte federal la semana pasada que Moreno López se fracturó la rótula durante el choque.

Sin embargo, los registros médicos presentados por sus abogados indican que ella informó al personal del hospital que sus lesiones ocurrieron después del accidente.

“Estaba saliendo de su vehículo cuando fue derribada al suelo y golpeó ambas rodillas, el codo y brazo derechos, así como el lado izquierdo de su rostro contra el concreto”, escribió uno de los médicos.

En su declaración jurada, Moreno López relató: “Salí de mi vehículo. Dos agentes de ICE me derribaron al suelo. Uno de ellos, con cabello naranja y barba, me jaló del cabello y de la camisa”.

El accidente involucró a Yerlys Moreno López chocando contra un vehículo estacionado cerca de su casa en el lado este de Detroit.

De acuerdo con sus expedientes médicos, Moreno López sufrió una fractura de rótula, una herida en la otra rodilla que requirió ocho puntos de sutura, una abrasión extensa en el antebrazo derecho, un golpe en la cabeza y moretones en el cuello y el rostro. No perdió el conocimiento durante el incidente y los estudios médicos no encontraron lesiones cerebrales graves, aunque fue diagnosticada con traumatismo craneal.

“Atención médica deficiente”

Después de la cirugía, los médicos recetaron rehabilitación ortopédica para Moreno López. Según los registros, esperaban que fuera trasladada a una instalación de ICE en Cincinnati capaz de atender sus necesidades médicas.

En lugar de ello, fue enviada a North Lake, donde personas detenidas han realizado huelgas de hambre para protestar por la falta de acceso adecuado a servicios médicos.

Según un informe reciente de la American Civil Liberties Union of Michigan, las deficiencias en la atención médica dentro de la instalación son “generalizadas y graves”.

Los registros médicos de North Lake presentados por el gobierno muestran que el plan inicial de atención para Moreno López consistía en caminar por un pasillo tres veces al día utilizando un andador.

Sus abogados sostienen que debe ser liberada de inmediato porque la “atención médica deficiente” del centro podría causarle daños irreparables.

Por su parte, los abogados de ICE argumentan que no existe evidencia de que Moreno López haya recibido atención médica inadecuada en North Lake.

GEO Group, la empresa con fines de lucro que opera el centro North Lake, remitió todas las preguntas a ICE.

“Estos incidentes no son solamente un asunto de política migratoria, sino también de derechos civiles y acceso a la atención médica para personas vulnerables”, señaló Christine Sauvé, portavoz del Michigan Immigrant Rights Center. “Realmente se trata de una crisis de salud pública. Pacientes como Yerlys pueden sufrir daños cuando son devueltos a centros de detención migratoria donde la atención médica especializada suele ser inexistente o insuficiente, a pesar de que las leyes y políticas exigen lo contrario”.
